Terms & Conditions

1. Acceptance of Terms
By requesting, scheduling, or receiving services from Penguin Window Cleaning (“Penguin,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not request or use our services.
2. Services
Penguin Window Cleaning provides professional residential and commercial window cleaning services throughout Dallas County, Hunt County, Kaufman County, Rockwall County, and Collin County, Texas.
The specific scope of services, pricing, and work to be performed will be agreed upon at the time of scheduling or included in the applicable estimate or invoice.
Penguin Window Cleaning reserves the right to decline, modify, postpone, or discontinue any service request when reasonably necessary, including when conditions at the property make the requested service unsafe or impractical.
3. Scheduling and Cancellations
Appointments may be scheduled by phone, email, through our website, or through other scheduling methods made available by Penguin Window Cleaning.
Customers should provide as much advance notice as reasonably possible when requesting a cancellation or rescheduling.
Any applicable cancellation fees, rescheduling policies, or other appointment requirements will be communicated to the Customer at the time of booking or before services are performed.
If a Customer is unavailable, fails to provide reasonable access to the property, or otherwise prevents the scheduled service from being performed without adequate notice, Penguin Window Cleaning may treat the appointment as a cancellation or rescheduling.
4. Access to Property
Customer agrees to provide Penguin Window Cleaning and its technicians with reasonable and safe access to the property and areas necessary to perform the requested services.
Customer is responsible for informing Penguin Window Cleaning of any relevant property conditions, access restrictions, security requirements, pets, hazards, or other circumstances that could affect the safe performance of the services.
If reasonable access is not available when the technician arrives, Penguin Window Cleaning may be unable to complete the service and may reschedule the appointment or apply any applicable cancellation or service fee communicated at the time of booking.
5. Payment
Payment is due according to the terms stated on the applicable estimate, invoice, or other payment agreement.
Penguin Window Cleaning may provide invoices through Jobber. Customers may be able to pay invoices online using the payment methods made available through the applicable Jobber payment system.
Penguin Window Cleaning does not directly store full payment card information when payments are processed through third-party payment services.
Past-due balances may be subject to applicable late fees or collection costs to the extent permitted by law and as disclosed to the Customer.
6. Satisfaction and Service Concerns
Your satisfaction matters to us. If you have a concern regarding the quality or completion of a service, please contact Penguin Window Cleaning as soon as reasonably possible after the service.
We will make reasonable efforts to review the concern and, when appropriate, return to address work that does not meet the agreed-upon scope of service.
Any remedy provided by Penguin Window Cleaning will be determined based on the circumstances, the agreed scope of work, and applicable law.
7. Property Conditions and Limitation of Liability
Penguin Window Cleaning will take reasonable precautions while performing services. However, window cleaning may involve working with existing windows, screens, frames, glass, seals, hardware, and surrounding surfaces that may be aged, fragile, improperly installed, previously damaged, or structurally compromised.
Penguin Window Cleaning is not responsible for damage resulting from:
Pre-existing damage or defects
Existing cracks, chips, scratches, or weakened glass
Windows, frames, screens, or hardware that are improperly installed, aged, deteriorated, or structurally compromised
Defects or conditions that are not reasonably visible or discoverable before services begin
Customer-provided equipment or materials
Conditions outside Penguin Window Cleaning’s reasonable control
Incidental or consequential damages, to the extent permitted by law
Customer agrees to inform Penguin Window Cleaning of any known issues or unusual conditions affecting the windows, screens, frames, or property before services begin.
To the extent permitted by applicable law, Penguin Window Cleaning’s total liability for a claim arising out of or relating to a particular service will not exceed the amount actually paid for the specific service giving rise to the claim.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
8. Insurance
Penguin Window Cleaning maintains appropriate general liability insurance for its operations.
Proof of insurance may be made available upon reasonable request, subject to applicable requirements and the availability of the requested documentation.
9. Communications
Penguin Window Cleaning may communicate with Customers using the contact information provided by the Customer, including by phone, email, and other communication methods used to manage requested services.
These communications may include:
Quote and estimate information
Appointment confirmations
Scheduling communications
Technician arrival information
Service updates
Invoices and payment-related communications
Responses to customer inquiries
Other communications directly related to requested services
If Penguin Window Cleaning offers promotional communications, those communications will be handled in accordance with applicable law and our Privacy Policy.
10. Photos and Property Documentation
Penguin Window Cleaning or its technicians may take photographs of windows, property areas, or completed work when reasonably necessary to:
Prepare or document an estimate
Document the condition of windows or property
Communicate about requested services
Document completed work
Address service concerns or disputes
Improve business operations
We will handle personal information and photographs in accordance with our Privacy Policy.
11. Customer Responsibilities
Customers are responsible for providing accurate contact and property information and for communicating any known conditions that could affect the safe or proper performance of the requested services.
Customers must not instruct or require Penguin Window Cleaning personnel to perform work in circumstances that are unsafe or that would violate applicable law or safety requirements.
Penguin Window Cleaning may refuse or stop work when, in its reasonable judgment, conditions are unsafe or the requested work cannot be performed appropriately.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions.
Any dispute arising from these Terms or Penguin Window Cleaning’s services shall be handled in accordance with applicable Texas law and in a court of competent jurisdiction.
13. Modifications
Penguin Window Cleaning reserves the right to modify these Terms and Conditions from time to time.
Updated Terms and Conditions will be posted on our website with a revised effective date. Changes will apply prospectively to services requested or performed after the updated terms become effective, unless otherwise permitted by applicable law.
